Terms of Service

1. Who operates VMD

VMD (VideoMarkdown) is founded and operated by Karandana Wariyapola Arachchige Ravidu Sohan Dananjaya (also referred to as KWA Ravidu Sohan Dananjaya), an individual based in Sri Lanka, as a sole proprietorship. Throughout this document, "we," "us," and "VMD" refer to this operation. VMD is not a registered company or corporate entity.

2. What VMD is

VMD is a declarative animation language, runtime, and browser-based IDE that lets you write structured text files that render into animated video output. VMD is offered under three tiers:

  • Free — full access to the IDE, DSL, and CLI, with a limited monthly allowance of AI generations and exports (exports are watermarked).
  • Starter pack ($29, one-time) — a prepaid bundle of export/AI generation credits, purchased as needed, not a subscription.
  • Pro ($59/month, recurring subscription) — a significantly higher (or unlimited, subject to fair-use limits) allowance of exports and AI generations, 4K export quality, and no watermark.

We may change what each tier includes, and may introduce, modify, or discontinue tiers, at any time. If a change materially reduces what you're paying for on an active Pro subscription, we'll notify you by email before it takes effect.

3. Your account

You need an account to use VMD beyond the publicly viewable parts of the site. You're responsible for:

  • Providing accurate information when you sign up
  • Keeping your login credentials secure
  • All activity that happens under your account

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account.

4. Ownership of what you create

You own the videos, scenes, and .vmd files you create using VMD. We claim no ownership over your output, your scripts, or your exported content. You're free to use, publish, sell, or license anything you create with VMD however you like.

You're responsible for making sure the content you create doesn't infringe on anyone else's rights (copyright, trademark, likeness, etc.) — VMD is a tool, and what you build with it is your responsibility.

5. Acceptable use

You agree not to:

  • Use VMD to create or distribute illegal content, or content that facilitates illegal activity
  • Abuse, scrape, or attempt to circumvent the AI generation endpoint (/api/ai/generate) outside normal product use
  • Attempt to bypass render, export, or AI generation quotas through technical manipulation, multiple accounts, or any other means
  • Attempt to gain unauthorized access to VMD's systems, other users' accounts, or non-public parts of the service
  • Use VMD's infrastructure to run unrelated compute workloads unconnected to producing VMD animations
  • Resell or redistribute VMD access itself (as opposed to content you create with it) without our written permission

6. Payment and billing

  • Payments are processed by Dodo Payments, acting as Merchant of Record. VMD never receives or stores your full card details.
  • Starter pack purchases are one-time and prepaid. Credits are added to your account on successful payment.
  • Pro subscriptions bill automatically on a recurring monthly basis until cancelled. You can cancel anytime from your account settings; you'll keep Pro access until the end of the current billing period, with no partial refund for the unused remainder (see our Refund Policy for full details).
  • Prices are shown in USD and may change. If we change Pro's price, we'll give existing subscribers at least 30 days' notice before the new price applies to their next billing cycle.

7. Account termination

By you: You can stop using VMD anytime. To close your account and request deletion of your data, email sohan@videomarkdown.com — see our Privacy Policy for what happens to your data when you do.

By us: We may suspend or terminate your account, with or without notice, if you violate these Terms, engage in fraudulent or abusive behavior, or if required to do so by Dodo Payments' compliance obligations as our payment processor. Where reasonably possible, we'll try to notify you first and give you a chance to fix the issue.

8. Service availability

VMD is provided on an "as available" basis. We do not guarantee uninterrupted or error-free operation. As a solo-operated product running on standard cloud infrastructure (Railway, Vercel, Supabase), scheduled maintenance, unexpected outages, or capacity limits can occur. We'll do our best to keep things running and to communicate any significant downtime, but we don't offer a formal uptime guarantee or service-level agreement at this time.

9. Third-party services

VMD relies on third-party services to function, including:

  • Dodo Payments — payment processing
  • OpenAI — powers the AI-assist feature (see Privacy Policy for details)
  • Pexels — stock image search within the IDE
  • Supabase — account authentication and data storage

Your use of features that rely on these services is also subject to those providers' own terms, to the extent applicable.

10. Limitation of liability

To the maximum extent permitted by law, VMD and Sohan personally are not liable for any indirect, incidental, or consequential damages arising from your use of the service — including lost data, lost revenue, or lost business opportunities — even if we've been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your use of VMD is limited to the amount you paid us in the 3 months preceding the claim.

Nothing in this section limits liability that cannot be limited under applicable Sri Lankan law.

11. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we'll update the "Last updated" date above and, for significant changes, notify active Pro subscribers by email. Continuing to use VMD after a change takes effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Sri Lanka, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of VMD will be subject to the jurisdiction of the courts of Sri Lanka.
